AnimGen Terms of Service

1. Definitions

"Service" means the AnimGen website, web application, APIs, billing flows, and related tools. "Input" means prompts, images, files, settings, and other content you submit. "Output" means videos, frames, spritesheets, metadata, and other assets generated or exported through the Service. "Credits" means usage units used to pay for eligible generation or processing jobs.

2. Acceptance and Scope

These Terms are between you and GeekArt Inc., the operator of the AnimGen service and brand.

By accessing or using the Service, creating an account, starting a generation job, buying Credits, or subscribing to a plan, you agree to these Terms. If you do not agree, do not use the Service.

These Terms apply together with our Privacy Policy and any pricing, checkout, usage, or safety notices shown in the product.

3. Eligibility, Account, and Security

You must be able to form a legally binding agreement and use the Service only where it is lawful to do so.

You are responsible for your account credentials, activity under your account, and keeping your email address current. Notify us promptly if you believe your account has been compromised.

4. The Service and License

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for creating, editing, and exporting game animation assets.

We may change, suspend, rate limit, or discontinue features when needed for reliability, security, legal compliance, provider availability, or cost control.

5. Your Content and AI Output

You retain the rights you have in your Input. You grant us the rights needed to host, process, transmit, store, transform, and display Input and Output to provide the Service.

Subject to your compliance with these Terms and any third-party restrictions, you may use Output generated with a paid subscription or paid Credit pack in commercial game projects.

AI Output may be inaccurate, incomplete, or similar to output generated for other users. You are responsible for reviewing Output before using it and for ensuring your use does not infringe third-party rights or violate law.

6. Model Training

We do not use your private Input or private Output to train our own models by default.

The Service relies on third-party AI and media processing providers. Those providers may process Input and Output as necessary to deliver the requested job and according to their own terms, data processing rules, and retention policies.

7. Prohibited Uses

You may not use the Service to create, upload, or distribute unlawful, abusive, infringing, deceptive, or unsafe content.

  • Content that infringes intellectual property, privacy, publicity, or contractual rights.
  • Sexual content involving minors or any content exploiting or harming children.
  • Malware, credential theft, fraud, spam, or attempts to bypass security or usage controls.
  • Harassment, hate, threats, non-consensual intimate content, or impersonation.
  • Attempts to reverse engineer, scrape, overload, resell, or provide unauthorized access to the Service.

8. Third-Party Services

The Service may use third-party providers for payment, hosting, email, analytics, AI video generation, background removal, storage, and infrastructure. These providers may include Paddle, Dodo Payments, Google Gemini/Veo, Photoroom, and similar services.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

9. Fees, Taxes, and Payments

Paid features may be sold as subscriptions or one-time Credit packs. Prices, plan benefits, Credit amounts, expiration dates, and taxes are shown at checkout or on the pricing page.

Payments may be processed by a third-party merchant of record, including Paddle or Dodo Payments. We do not store full card numbers or CVV.

10. Subscriptions, Credits, and Expiration

Subscriptions renew automatically unless cancelled before the renewal deadline shown in your billing flow.

Cancelling a subscription stops future renewals but does not necessarily remove access to paid benefits before the end of the current paid period.

Credits may expire, may be consumed when a generation or processing job starts, and may be deducted based on model, duration, resolution, frame count, output size, transparency processing, provider cost, and risk controls.

We may adjust Credit consumption rules for future jobs when provider pricing, product features, or abuse controls change.

11. Cancellations and Refunds

Refund eligibility depends on the payment provider, applicable law, and the status of the purchased service. Where a third-party provider is the merchant of record, that provider's refund and consumer terms may apply.

Consumed Credits, completed generation jobs, and third-party provider costs already incurred may be non-refundable unless mandatory law requires otherwise.

To request help with a refund, contact us with your account email and transaction ID.

12. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe there is a violation of these Terms, legal risk, fraud, abuse, security risk, or provider restriction.

After termination, we may retain records required for legal, tax, security, billing, and audit purposes.

13. Intellectual Property

We and our licensors retain all rights in the Service, including software, interface design, workflows, documentation, trademarks, and underlying technology.

These Terms do not transfer ownership of our Service or any third-party model, provider, or platform technology.

14. Disclaimers

To the maximum extent permitted by law, the Service and Output are provided as is and as available, without warranties of any kind.

We do not guarantee uninterrupted availability, provider uptime, exact generation results, legal suitability of Output, or compatibility with every game engine or production pipeline.

15. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption.

Our aggregate liability for claims related to the Service will not exceed the fees you paid for the relevant paid service during the 12 months before the event giving rise to the claim, or USD 100 if you paid nothing, unless mandatory law requires otherwise.

16. Indemnity

You agree to defend, indemnify, and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from your Input, Output, use of the Service, violation of these Terms, or violation of third-party rights.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China, excluding conflict of laws rules, unless mandatory law requires otherwise.

Disputes shall be submitted to a competent People's Court with jurisdiction in the PRC, unless mandatory law provides another forum.

18. Changes to These Terms

We may update these Terms from time to time by posting a revised version and changing the Last updated date. Continued use after the effective date means you accept the updated Terms.

If there is any inconsistency between English and Chinese versions, the English version controls unless mandatory law requires otherwise.
